Order of the Minister of Finance of the Republic of Kazakhstan dated March 31 2015 ¹250 on the establishment criteria for classification of goods conveyed by natural persons across the customs border of the Customs Union, to goods for personal use.

 

In accordance with paragraph 3 of article 464 of the Code of the Republic of Kazakhstan dated 30 June 2010 “On Customs Affairs in the Republic of Kazakhstan” I ORDER:

    Set the criteria for classification of goods, conveyed by natural persons across the customs border of the Customs Union, to goods for personal use in accordance with Annex to this order.

    State Revenue Committee of the Ministry of Finance of the Republic of Kazakhstan ( Ergozhin D.E ) in accordance with the legislation to provide:

    the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

    within ten calendar days after the state registration of this order its direction on official publication in periodicals and legal information "Adilet" system;

    Placement of this order on the internet-resource of the Ministry of Finance of the Republic of Kazakhstan.

3. This order shall come into force after ten calendar days after its first official publication.

The criteria for classification of goods transported individuals across the Customs Union, to goods for personal use

    Depending on the nature and quantity of the goods, as well as the frequency of the movement of goods conveyed by natural persons across the customs border of the Customs Union, the goods do not apply to goods for personal use, if:

 

    Such are the goods:

raw materials;

semi-finished products intended for the production of goods;

components;

2) the number exceeds the following indicators:

Clothing and apparel - 2 (two) object of one type, size and style per person;

Bedding –sets of one type of person;

carpets and other textile floor coverings - 2 (two) the subject of one name per person;

hats - object of one type, size and style per person;

Shoes - 2 (two) the object of one type, size and style per person;

fur - item a name, size and style per person;

leather - 1 (one) item a name, size and style per person;

toiletries and perfumes and cosmetic products – 3 (three) the subject of one name per person;

food – 10 (ten) kilograms per person;

mobile phone – 2 (two) units per person;

tablet – 2 (two) units per person;

Portable laptop computer and its accessories (laptop, netbook) – 2 (two) units per person;

household appliances and electrical equipment – 1 (one) item of each item per person;

Jewelry - 5 (five) items per person;

Bike - 1 (one) piece per person;

Baby buggy – 1 (one) piece per person;

Other, than the above items intended for personal use - 2 ( two) of the subject of each item per person;

2) the intersection of the frequency of physical persons and (or) move their goods across the customs border of the Customs Union of more than one (1) once a month.

2. Means of transport for personal use through the customs border of the Customs Union, if their number exceeds 1 (one) unit per year shall be considered as held for business.

3. The indicators do not apply to goods that were in use (with the exception of vehicles for personal use).

In connection with the advent of mass media materials, incorrectly interpreting certain provisions of the order of the Minister of Finance of RK “On establishing the criteria for classification of goods conveyed by natural persons across the customs border of the Customs Union, to goods for personal use”, the State Revenue Committee of the Ministry of Finance of the Republic of Kazakhstan considers in necessary to make the following clarification.

As is known, May 2 2015 came into force on the order of the Republic of Kazakhstan Minister of Finance dated 31 March 2015 “On establishing the criteria for classification of goods conveyed by natural persons across the customs border of the Customs Union, to goods for personal use”.

This Order regulates the legal relations arising in connection only with the movement of goods by individuals for personal use through customs border of the Customs Union in the accompanied and unaccompanied luggage.

The provisions of this Order shall not apply to goods for personal use the are delivered by the carrier to the individual and goods for personal use, sent by international mail to the customs territory of the Customs Union in force the following regulations.

June 18, 2010 in St. Petersburg partners in the Customs Union signed an Agreement on the procedure for movement of goods by individuals for personal use through customs border of the Customs Union and customs operations connected with their release

In accordance with the following criteria established by the Agreement for goods for personal use, transported across the customs border with exemption from customs duties:

However, as in Annex 3 to the Agreement did not set quanti criteria for classifying goods for personal use, the criteria defined in the national legislation.

Thus, the Law of the Republic of Kazakhstan dated December 29, 2014 269-V “On introducing amendments and addenda to some legislative acts of Kazakhstan on the radical improvement of the business environment in the Republic of Kazakhstan” in paragraph 3 of article 464 of the Code of the Republic of Kazakhstan dated June 30, 2010 “On customs affairs in the Republic of Kazakhstan” made to supplement as follows:

“The criteria for classification of goods conveyed by natural persons across the customs border of the Customs Union, to goods for personal use to the extent not regulated by an international agreement of the Member States of the Customs Union shall be determined by the authorized body in the field of customs based on the nature and quantity of goods, the frequency of the intersection of a natural person and (or) move their goods across the customs border of the Customs Union”.

Accordingly, May2, 2015 came into force on the order of the Republic of Kazakhstan Minister of Finance dated 31 March 2015 “On establishing the criteria for classification of goods conveyed by natural persons across the customs border of the Customs Union, to goods for personal use” (hereinafter – the Order), registered in the Register state registration of normative legal acts of the April 16, 2015 ¹ 10738.

The Order regulates the legal relations arising in connection with the movement of goods by individuals for personal use through customs border of the Customs Union in the accompanied and unaccompanied baggage (see graph 1 table).

Definitions:

Unaccompanied baggage - goods for personal use, belonging to an individual, transferred or transmitted to the carrier under a contract of international transport (freight forwarding) for the actual moving through customs border of the Customs Union in connection with the entry of that person into the territory of the Customs Union or departure from the customs territory Customs Union:

Accompanied baggage - goods for personal use, including hand luggage, directly transferred by an individual crossing the customs border of the Customs Union;

Goods for personal use, delivered by a carrier, - goods for personal use, transferred or transmitted to the carrier under a contract of international carriage (invoice, bill of lading and other documents) for the actual movement of the objectives through the customs border of the Customs Union to the individual or from an individual, do not cross the customs border of the Customs Union;

International mail - postage, received for shipment outside the customs territory of the Customs Union, entering the customs territory of the Customs Union, or in transit through the territory, and accompanied by the documents provided by the Universal Postal Union.

 

Thus, again, please note that the rules of the Order do not apply to goods for personal use that are delivered by the carrier to the individual and goods for personal use, sent by international mail to the customs territory of the Customs Union.

It should be noted that under Article 3 of the Agreement, the assignment of goods transported by natural persons across the customs border, goods for personal use is carried out by the customs authority with a risk management system based on the nature, quantity of goods and the crossing frequency of the individual and (or) move their goods through the customs border.

INFORMATION

for the visitors of the International Center of Border Cooperation "Khorgos"

In order to create favorable conditions for the visitors to ensure public order and safety , for proper control and elimination facts of smuggling of goods , to ensure compliance with the established boundary regime in the territory of the checkpoint-1 ICBC "Khorgos" were carried out a number of organizational measures.

In the area adjacent to the multifunctional building (MFB) area installed fence that marks the beginning of border control zone established regime of the State border. In accordance with the current legislation of the Republic of Kazakhstan in the restricted zone is necessary to observe the established requirements and restrictions, prohibited the movement without a passport of a citizen of the Republic of Kazakhstan or missing, a standard form issued by the Border Guard Service or other permits. Violation of rules of stay in the area of border control regime and shall be liable under the legislation of the Republic of Kazakhstan.

Beginning of work checkpoint-1:

from 1 May to 30 September - from 08.30 to 18.00 (the Astana time);

from 1 October to 30 April – from 9.00 to 17.00 (the Astana time);

The start and completion of the transport on the territory:

from 1 May to 30 September - from 08.30 to 17.30 (the Astana time);

from 1 October to 30 April – from 9.00 to 16.30 (the Astana time);

The entry/exit of visitors to/from Center via the passenger terminal (the blocks “A”, “B”) Checkpoint-1 multifunctional building with the function of border and customs control (hereinafter, MFB).When letting individuals made border, customs and other types of control provided for by the legislation of the Republic of Kazakhstan as well as in other border crossing points of the State border.

At the entrance to the territory of the Checkpoint-1 passenger bus registered on the E-checkpoint and lane carriageway reserved for passenger transport, it should be to block "A" MFB.

Individuals in the "A" block pass the border, customs and other types of control. Customs control is carried out using a double corridor system.

Baggage exceeding the dimensions of hand luggage is dealt at some point for luggage and delivered to the baggage car inspection warehouse, processing and issuing located in the area of ​​Checkpoint-1 inspection of cargo flow in the building of an in-depth inspection.

Belonging to the category of goods for personal use is determined in accordance with the rules approved by the Order ¹250 from 03.31.2015 "On establishment of criteria for classification of goods conveyed by natural persons across the customs border of the Customs Union, to goods for personal use”.

Baggage, together with hand luggage whose parameters exceed the established norms for personal use in weight (50kg), value (no more than 1500 euros) and quantitative characteristics, subject to customs clearance and payment of the corresponding tariff (in the case of exceeding 50kg-4 euros for each kg of exceeding the norm).

If the officer determines the customs goods, located in the luggage of a commercial commodity, all goods are subject to customs clearance, without taking into account the weight and cost standards.

On the commercial shipment customs authorities may request the shipping documents, certificate of conformity.etc.

The visitors fare includes the cost of 1 piece of hand baggage not exceeding the parameters se – 35kg and 20x40x60cm.
